Source Methodology

Last updated: April 2026

Formation.Legal produces decision-support content for non-US founders. Every guide, provider review, and tool recommendation follows a structured research methodology designed for accuracy, transparency, and operational relevance.

1. Primary Source Priority

We prioritize official, primary sources over secondary commentary:

  • State statutes and Secretary of State websites for entity formation rules.
  • IRS publications and instructions for tax obligations (Form 5472, EIN requirements, etc.).
  • FinCEN rulings for BOI reporting requirements.
  • Payment processor documentation (Stripe Atlas docs, PayPal business policies) for eligibility criteria.
  • Bank compliance disclosures for account opening requirements.

2. Provider Testing

Where feasible, we test formation providers directly. We document the actual process, timeline, and outcome rather than relying solely on marketing materials. Provider reviews marked with a "Tested" badge indicate first-hand experience.

3. Community Data Points

US business formation for non-residents involves rapidly changing policies (especially around banking and payment processor approvals). We supplement our primary research with anonymized community data points from founder forums, immigration attorney insights, and CPA consultations.

4. Update Cadence

Every guide includes a visible "Last Reviewed" date. Our target review cadence is:

  • High-impact guides (Stripe access, banking): Quarterly review.
  • Compliance guides (annual filings, BOI): Updated within 30 days of regulatory changes.
  • Provider reviews: Updated when pricing, services, or policies change materially.

5. What We Do Not Do

  • We do not guarantee outcomes. Banking approvals, Stripe access, and compliance depend on your specific situation.
  • We do not provide legal, tax, or financial advice. See our Disclaimer.
  • We do not accept payment from providers to alter research findings.
